For Immediate Release

Iran: Drop Case Against ‘Happy’ Youth
Seven Face Possible Charges Over Music Video

(Beirut, May 25, 2014) – Iran’s judiciary should drop the case against seven youth for participating in a video showing them dancing and end any further legal proceedings or harassment against them and their families, Human Rights Watch said today. Authorities released six of the seven on bail on May 21, 2014, the day after authorities showed the suspects on television “confessing” and expressing remorse for their roles in the video.

Iranian police arrested the four men and three women several weeks after a video that showed the youths dancing to the popular song “Happy,” sung by Pharrell Williams, went viral on YouTube. The video shows the youth dancing, solo and together, in various public and private locations, apparently in Tehran. The women in the video are not wearing a hejab, a headscarf or shawl used to cover a woman’s hair, which is required in public. Public dancing or depictions of such dancing, especially between men and women, is generally forbidden. Authorities are still holding Sassan Soleimani, who is alleged to have directed the YouTube video.

“People who express themselves through music and dance are not committing a crime,” said Sarah Leah Whitson, Middle East director at Human Rights Watch. “Iran’s judiciary should not be pursuing these charges.”

On May 20, a state television program showed six young men and women whose faces had been blurred and identified them as those who had appeared in the YouTube video. During the program the youth said that they did not intend for the video to be publicized and that they had been tricked into taking part in it. A police commander for Greater Tehran, Hossein Sajedinia, said on the television program that authorities identified the six and arrested them within hours after the video was posted, which seemed to contradict reports suggesting that the authorities arrested them weeks after the video was initially uploaded online. He warned Iran’s youth against engaging in similar activities and said security forces would similarly deal with others who made such videos.

Two of those in the video who were released on bail are Reyhaneh Taravati and Afshin Sohrabi. The other four have only been identified by their first names (or stage names) as “Neda,” “Bardia,” “Roham,”and “SPDH.”

It is not clear whether the youth have been charged, though their release on bail suggests that authorities are considering prosecution. Iranian authorities have previously relied on various morality and cybercrimes laws to punish those engaged in activities considered immoral or prohibited under Sharia, or Islamic law. Sentences for violating these laws can include fines, imprisonment, and lashings.

The arrests occurred against a backdrop of statements by President Hassan Rouhani urging greater Internet freedom in the country, and apparent disagreements between various branches of government over the extent to which authorities should police and censor the Internet. On May 21, the day authorities released the youths, the administrator of a Twitter account linked to the presidential office retweeted a tweet from June 2013 that read: “Happiness is our people’s right. We shouldn’t be too harsh on behaviors caused by joy.”

YouTube and Facebook are blocked in Iran, but millions of Iranians access these and other filtered sites using proxy servers and other filter-evading technology.

New fact-finding mission: UN expert to probe human rights in Iran through diaspora in Europe

GENEVA (26 May 2014) – The United Nations Special Rapporteur on the situation of human rights in the Islamic Republic of Iran, Ahmed Shaheed, will undertake his latest fact-finding mission in Sweden, Austria, and Italy, which host significant Iranian diaspora populations.

From 27 May to 6 June 2014, the independent expert will gather information about the recent experiences of victims of alleged human rights violations in Iran, and will meet with relevant experts and officials in order to asses current reports coming from Iran.

“While I am encouraged by recent conversations, statements, and overtures by Iranian officials, I am concerned by consistent reports that the human rights situation on the ground has yet to improve, and that pledges have simply not translated into results,” Mr. Shaheed underscored.

“The mission, therefore, will provide an opportunity to accurately evaluate and analyze recent progress, or lack of it, through conversations with individuals with diverse backgrounds and opinions,” he said.

During his ten-day visit, the Special Rapporteur will meet with and interview members of the Iranian diaspora and other members of Iranian civil society, including journalists, student activists, lawyers, authors, publishers, proponents of minority, women’s, and children’s rights. He will also meet with relevant NGOs and Government officials in Sweden, Austria, and Italy.

Mr. Shaheed’s most recent findings on the human rights situation in the Islamic Republic of Iran will be brought to the attention of the Government of Iran and to the member states of the UN General Assembly during its 69th Session, later this year.

The Special Rapporteur restated his commitment to constructive dialogue and cooperation as a means of addressing and resolving human rights concerns in Iran. He noted that the upcoming assessment of Iran’s human rights record by other States during the Universal Periodic Review (UPR) represents a potential major opportunity in this regard.

“The Islamic Republic of Iran has often stressed the importance of the UPR process as a universal and impartial mechanism for the evaluation and discussion of human rights situations the world-over,” the independent expert noted.

“I truly hope that the Government will use this opportunity to genuinely reflect on its human rights record over the past four years, and, in the spirit of cooperation, to engage in frank discussion with its peers at the United Nations with a view toward prompt and quantifiable improvement,” Mr. Shaheed said.

Since his appointment in August 2011, the Special Rapporteur has issued three reports to the UN General Assembly and three additional reports to the Human Rights Council on the situation of human rights in Iran.

Mr. Shaheed has made several official requests to the Government of Iran for a country visit since his appointment without obtaining an affirmative response. He continues to call on the Iranian authorities to cooperate with his UN Human Rights Council mandate with a view to addressing its human rights challenges.

“Happy” Video Director Linked to Rouhani Campaign Remains in Detention !

Sassan Soleimani, the director of one version of the ”Happy in Tehran” video, remains in Rajaee-Shahr Prison in Karaj where he is being deprived of sleep, days after six people who appeared in the video were released from detention, a source told the International Campaign for Human Rights in Iran.
Soleimani, a 33-year-old filmmaker and animator, told Zendegi Ideal (Ideal Life) magazine in 2013 that when he was taking photos for Hassan Rouhani’s presidential election campaign, campaign officials asked him to suggest a color for campaign materials and he chose purple, which became Rouhani’s official color during the campaign.
Authorities had told Soleimani’s family that he could be released on bail but as of May 24 he was still in prison. The family was told to come back in one week for a visit.
On May 19, the morality police arrested three men and three women on charges of dancing in a video based on Pharrell Williams’ international hit song, “Happy” and held them at the unit’s station on Vozara (Khaled Eslamboli) St. in Tehran. They were released two days later after posting bail of between 300 million and 500 million rials each (between about $10,000 and $16,600).
The Campaign has learned that while the six were in detention, they were pressured by interrogators into accusing Soleimani of tricking them.
Soleimani was arrested on May 20 while agents confiscated his personal computer and other belongings from his home. Bail was set at 500 million rials ($16,600) but officials have not let him go free despite the family’s preparedness to pay.

Soleimani was previously arrested for making the “Soosan Khanom” video for the Barobax pop band in Iran.

Urgent appeal to the Iranian Government: Halt the scheduled execution of Ahwazi Arab men

GENEVA (21 May 2014) – A group of United Nations human rights experts* today urged the Iranian authorities to halt the scheduled execution for tomorrow, Thursday 22 May, of two Ahwazi Arab farmers and cultural rights activists, after their death sentences were reportedly upheld by the Iranian Supreme Court.
The UN experts expressed alarm over the case of Ali Chebeishat and Sayed Khaled Mousavi, who were arrested in November 2012 and sentenced to death on charges of Moharebeh (enmity against God) by a Revolutionary Court in September 2013.
Both men have reportedly been subjected to severe mistreatment and beatings, possibly amounting to torture. They have now been held incommunicado for over two months, and neither their lawyer nor family members have been able to obtain official information regarding their current whereabouts or the status of their cases.
The human rights experts expressed further serious concern over reports that the accused were not afforded due process or fair trial standards in accordance with both domestic and international law.
“First and foremost, the Iranian authorities must stop the executions and the accused should be permitted a new, fair trial,” they said. “The authorities must also cease any and all retribution against family members for allegedly speaking with international organizations, including the United Nations.”
“The Iranian authorities must promptly inform Messrs. Chebeishat and Mousavi’s families of their whereabouts, and allow their families and their lawyers’ access to details regarding the status of their cases, in accordance with both international and Iranian law,” the experts stressed.
“The accused were convicted either primarily or solely on the basis of a televised ‘confession’ which appeared on Iranian State TV in June 2013,” the rights experts said, noting with concern that they were apparently not allowed legal representation of their own choosing and were later denied regular access to their court- appointed lawyer.
“The timing of the video release, as well as its content, beg serious questions about its legitimacy as evidence in the conviction and sentencing of these men to the most serious and irreversible fate possible,” they underscored.
(*) The experts: the Special Rapporteur on the situation of human rights in Iran, Ahmed Shaheed; the Special Rapporteur on extrajudicial, summary or arbitrary executions, Christof Heyns; Special Rapporteurs on minority issues, Rita Izsák; and the Special Rapporteur on the independence of judges and lawyers, Gabriela Knaul; and the Working Group on Arbitrary Detention.

HRW Press: Mounting Pressure on Baha’is

Iran: Mounting Pressure on Baha’is
Facing Prison, Cemetery Destruction

(Beirut, May 20, 2014) – Iranian authorities should ensure that prison sentences against 20 Baha’is unlawfully convicted of national security crimes are overturned, Human Rights Watch said today. Security and intelligence forces arrested the group of 20 in July 2012. Authorities should also halt the Revolutionary Guard bulldozing of an old Baha’i cemetery in Shiraz.

The appellate court ruling, issued on April 13, 2014, follows lower court convictions of the group in 2013 on charges of “propaganda against the state” and “propaganda on behalf of groups or organizations acting against the state.” Several defendants told Human Rights Watch that the convictions followed prolonged periods of solitary confinement and interrogation by Intelligence Ministry agents, who subjected detainees to physical and psychological ill-treatment.
“These transparently political charges make it painfully clear that authorities have targeted the Baha’is not for any crime but because of their religious beliefs,” said Joe Stork, deputy Middle East and North Africa director at Human Rights Watch. “It’s hard to understand how members of the judiciary can justify such religious intolerance.”

The ruling issued by branch 1 of Yazd’s Appellate Court, with an average of two to three years per defendant, stems from a campaign targeting Baha’is in central Iran. On July 31, 2012, Intelligence Ministry agents raided the homes and businesses of the 20 Baha’is in the cities of Yazd, Esfahan, Arak, Shahinshahr, Vilashahr, and Kerman. Defendants who spoke to Human Rights Watch described how the agents searched their homes, confiscated personal belongings including birth certificates, bank statements, and religious material, then arrested them and took them to detention facilities in Yazd.
The defendants are out on bail. Fariborz Baghi, who was sentenced to two years in prison and given a one year suspended sentence, told Human Rights Watch that over the course of a month in a Yazd detention facility: “I was subjected to a lot of psychological and emotional pressure…. They told me if you don’t confess to everything we will bring your daughter and your son here too … they did not say what they would do to them.” Baghi’s wife, Nategheh Jafari Naeimi, told Human Rights Watch that agents arrested her and took her to a women’s detention facility, where she was in solitary confinement for 17 days during her interrogation. They later released her on bail.

Another defendant, Iman Rashidi, told Human Rights Watch that one of his interrogators insulted and cursed him and other Baha’is, and struck him on the head from behind on two occasions. Rashidi said he was in solitary confinement for 15 days, and was allowed to contact his family only on his 21st day of detention. The court sentenced Rashidi to three years in prison and a one year suspended sentence.

Several defendants said that during the two-day lower court trial, which lasted about three hours each day, the government provided little evidence substantiating the charges against them:
The judge first read the charges against us aloud and then asked if we wished to defend ourselves. Then he immediately asked us and our lawyer to provide our last defense. I felt as if they had already made a final decision and had issued the verdict before our trial, and before hearing our words and our lawyer’s defense.
Another defendant, who wished to remain anonymous, said that several days after the lower court issued its verdict, a member of the judiciary told him: “In the Islamic Republic of Iran, the constitution does not acknowledge any rights for you. You are not considered citizens. If it were up to me you would not have the right to live, either.”

Mehran Amirabadi, a 45-year-old Yazd resident who was sentenced to a year in prison and a one year suspended sentence, said that the judge accused the group of being in touch with Israel without providing any proof:
They never provided evidence for the charge of “propaganda against the regime”. They just said that all 20 of us were part of an organized network. I asked the judge what evidence substantiated the charges against us. The judge looked at the prosecutor’s representative, who nodded his head. Then the judge answered that the representative of the prosecutor will inform you later.... How can I defend myself if the prosecutor’s representative is going to inform me of the evidence for my charges later? Then, the judge related us to Israel, and [said that] we are in touch with Israel without any proof, evidence, and witness.
Haifa, in present-day Israel, is the faith’s administrative headquarters since 1868, when Haifa was under Ottoman rule. The Iranian government has repeatedly used the connection to accuse Baha’is in Iran of spying for Israel, with which Iran has hostile relations.

The Baha’i International Community says that as of December 2013, there are 136 Baha’is that are in prison in Iran solely on religious grounds. Among those are the seven former Baha’i leaders, who are nearly six years into 20-year sentences in a trial that fell short of international standards. The seven are: Fariba Kamalabadi, Jamaloddin Khanjani, Afif Naeimi, Saeid Rezaie, Mahvash Sabet, Behrouz Tavakkoli, and Vahid Tizfahm.
Those arrested on July 31, 2012, are: Farahnaz Misaghian Ardakani, Shabnam Mottahed, Iman Rashidi Azabadi, Fariba Ashtari, Nategheh Jafari Naeimi, Shahram Fallah, Navid Haghighi Najafabadi, Khosro Dehghani Mohammadi, Farah Baghi Asrabadi, Mehran Eslami Amirabadi, Azam Motahari, Azar Meidokht Toloui Mehdiabadi, Safa Golshan, Enayatollah Taghipour, Sasan Haghiri, Shahram Eshraghi Najafabadi, Tahereh Rezaeidashti, Naghmeh Farabi, Vida Haghighi, and Fariborz Baghi.

In a separate development, on or around April 21, 2014, authorities began excavating an old Baha’i cemetery, “Golestan-e Javid” (Eternal Paradise), in the southern city of Shiraz. Two Baha’i residents, who have family buried in the cemetery, told Human Rights Watch that the Revolutionary Guard began bulldozing the cemetery despite efforts by the community to prevent demolition of the site.
Defacing and destruction of religious or sacred sites, including cemeteries where Baha’i leaders and ordinary members of the community are buried, has also been part of the systematic campaign of government repression targeting Iran’s Baha’i community since the 1980s, Human Rights Watch said.

One resident, who wished to remain anonymous, said that his mother’s cousin, who was among a group of Baha’is executed by the government in the early 1980s, was buried in the cemetery, but that since the government confiscated the property in the 1980s the Baha’i community had not been able to use the site for burials. The resident also said that local Baha’is had complained to various governmental authorities to stop the excavation, to no avail.
In a recent interview with the Persian-language Radio Farda, a Baha’i International Community spokesperson, Simin Fahandej, said that the land on which the Baha’i cemetery sits is now owned by a Revolutionary Guard, and that three years ago it announced plans to build a cultural and sports complex on the site. The cemetery’s burial ground holds the remains of more than 900 Baha’is, including “10 women who were hanged in 1983 for their refusal to recant their Baha’i beliefs,” the Baha’i International Community said in a May 8, 2014 statement.

According to the Baha’i International Community, between 2005 and 2012 “at least 42 Baha’i-owned cemeteries were attacked in some manner.”

“The targeting and harassment of Baha’is, both living and dead, shows how deeply entrenched the government’s intolerance is against Iran’s Baha’i community,” Stork said. “Those who are supposed to be protecting the Baha’i community should call a halt to this campaign of repression.”

Babak Abazari Manager of Nasira Publications : I was threatened with overrun by car !

Babak Abazari is a poet and publisher and the manager of the "Nasira " publications. His publishing firm was also part of the Tehran Book Exhibition but was ordered to be closed by Ministry of Guidance.

Speaking with" Akhbar Rooz " website ,He said; during and after the closure, he was threatened by security forces because of displaying some books . He said; I thought the threatening will end, but instead it was increased and i had the fear someone may attack at me , in this situation and for my own safety i decided to leave Iran. I was told by plain clothes security forces that, we are selling the poetry book of a counter revolutionaries living in Los Angeles ( Amir Mohebian) and they threatened me with overrun by a car . They also threatened they would revoke my publishing license , they asked me to keep quiet and not to speak to any media , and  to publish some religious books for now until they will find out about my views. He says, the officials in Ministry of Guidance told him that his case file is with security forces and he does not know who they are , but believe they may be are from Sepah intelligence.
We are facing a dual power struggle in Iran and the regime is trying to show things are beautiful but deep inside it is not. More than 100 books did not get permission for publication and many publishing company's are closed because of censorship.

Radical Fundamentalist are Free to make rally but Labor unions aren't under Islamic regime in Iran !

While radical fundamentalists are making rally without getting permission from ministry of interior , the labor union are not allowed to make rally on May day International labor day and are being arrested and detained.
On Wednesday fundamentalist Islamic forces made a pro Hijab rally in Tehran without even applying for permission from ministry of interior. It is illegal to make rally without getting permission , but it seems not for these group of people. Who are behind them which makes them special ? These forces are the darlings of the Islamic regime , the backbones of the Islamic regime , ready for any kinds of violence against Iranian people. We have seen these forces in green movement ( 2009 presidential coup acting violently against peaceful Iranian protesters). These forces are consists of Radical fundamentalist Basiji militias or Members of Sepah ( Revolutionary Guards), agents of Ministry of Information and  fundamentalists clergies .....Some members of Parliament who are pro" Jebhe Paydari" and followers of Ayatollah Mohammad Taghi Mesbah Yazdi.
This picture shows Kochakzadeh an MP on a motorcycle leading the pro Hijab rally.
